These terms and conditions govern all transactions on this website and the use of this website. Please read them carefully before purchasing. By accessing this website and/or placing an order, you agree to be bound by them in full. If you do not accept them, do not use this website or purchase the product.

What Is in Xanthel ®

All ingredients are listed on the container. The formulation is manufactured in a European laboratory in conformity with ISO 22716 (Good Manufacturing Practice for cosmetics), accredited for own-label and private-label production. Xanthel ® is a cosmetic product for external use. It is not a medicine, contains no medicines or medications, and its ingredients are permitted for cosmetic use.

Acknowledgement and Assumption of Risk (You Must Read This)

By placing an order you confirm and agree to all of the following. These confirmations form part of the contract between us.

  • You have read, understood, and will strictly follow all supplied instructions, the mandatory patch-test requirement, the contraindications listed below, and the aftercare guidance. You accept that the product must be used exactly as directed and that any departure from that guidance is at your own risk.
  • You confirm that you have read the contraindications below and that, to the best of your knowledge, none of them applies to you. If any applies, or you are in any doubt, you will not use the product without first obtaining advice from a qualified medical professional. You accept full responsibility for this confirmation.
  • You understand and accept that, as with any cosmetic peel applied near the eye, use carries inherent risks, including temporary redness, irritation, and, particularly where instructions or aftercare are not followed, the possibility of pigment change or scarring. You voluntarily assume these risks as a condition of purchase and use.
  • You are purchasing and using the product entirely of your own free choice and judgement, and you accept full and sole responsibility for your decision to use it and for the manner in which you use it.
  • You understand that results vary between individuals, that the product may not work as you hope, and that no specific cosmetic result is promised or guaranteed.

If you do not accept these conditions in full, do not purchase or use the product.

The Contract Between Us and You

Any contract for purchases made through this website is with BGI Northern Limited (“we”, “us”, “our”), trading as Xanthelasma.com. We must receive payment in full before your order is accepted and a contract is formed. Our acceptance of your order, at our discretion, creates a legally binding contract on these terms. Any term you seek to impose in your order has no effect and does not form part of the contract.

We may refuse, withdraw from, or cancel any order or contract at our sole discretion, including in the case of pricing or product errors or inaccuracies on the website. Where we do so after payment, our only obligation is to refund the sum paid for the affected item, and we are not liable for any further loss, cost, or disappointment.

Nature of the Product

Xanthel ® is a cosmetic product intended for the cosmetic removal of xanthelasma (the visible yellow marks on the eyelids) at home. It is for external cosmetic use only. It is not a medicine and is not intended to diagnose, treat, cure, or prevent any medical condition. Nothing on this website is medical advice or a substitute for it. Because xanthelasma can occasionally sit alongside underlying lipid, thyroid, or cardiovascular factors, you should consult your doctor for a check; that is your responsibility, not ours.

The product is intended solely for eyelid xanthelasma. It is not intended for, and must not be used on, any other condition, lesion, or area. Use of the product for anything other than its intended purpose is entirely at your own risk and outside the scope of any responsibility on our part.

Contraindications, Do Not Use This Product If

  • You are using, or have used within the last 24 months, isotretinoin (Accutane), as scarring may result.
  • You have herpes simplex in the area.
  • You are pregnant.
  • You are breastfeeding.
  • You are prone to keloid scarring.
  • You are undergoing chemotherapy or radiation therapy.
  • You are immunocompromised, including if you are HIV positive or have AIDS.

You must also:

  • not apply the product where you have used hair-removal products, shaved, or used granular exfoliation or buffing pads within the previous few days; the skin must be non-irritated;
  • discontinue acid-based products, retinoids, acne treatments, and exfoliators for 48 hours before application and for two weeks afterwards;
  • carry out the supplied patch test before use; and
  • keep the product out of the reach of children.

By placing an order you confirm you have read and understood these contraindications and that you use the product on the basis set out in the Acknowledgement and Assumption of Risk section above. Misuse of cosmetic peel products can cause injury, and responsibility for using the product correctly rests with you.

Sun Sensitivity After Use

After use, your skin may be more sensitive to sunlight for a period. You should apply a broad-spectrum sunscreen of at least SPF 30 to the area for at least one week after use and avoid strong sun exposure during healing. Following this guidance is your responsibility.

Payment

Payment can be made by the methods shown at checkout. Prices and charges are shown in pounds sterling or US dollars; your card provider performs any currency conversion. We may decline or cancel any transaction at our discretion.

Delivery, Lost Items, and Damage in Transit

Our full delivery terms are in our Shipping Policy. Where an item is not delivered, please contact us so we can investigate with the carrier; where an item is confirmed lost, we will, at our option, offer a refund or replacement. For items damaged in transit, you must contact us with clear photographs of both the packaging and the goods before any claim can be processed; we will then, at our option, offer a refund or replacement. You must retain the packaging and goods until the matter is resolved. We are not obliged to offer any compensation beyond a refund or replacement of the affected item.

Availability of Goods

If we are unable to supply goods you have ordered, we will notify you and refund any sum paid, normally within 30 days. Beyond that refund, we have no further liability and are not obliged to offer additional compensation.

Limitation of Liability

You use the product of your own free choice and accept sole responsibility for following the supplied instructions, the patch-test requirement, the contraindications, and the aftercare guidance.

To the fullest extent permitted by law, our total liability to you in connection with any order, the product, or your use of this website, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall not exceed the total amount you paid for the product giving rise to the claim.

To the fullest extent permitted by law, we shall not be liable for any loss or damage arising from:

  • your failure to follow the supplied instructions, the patch-test requirement, the contraindications, or the aftercare guidance;
  • your use of the product where a contraindication applied to you;
  • your use of the product on any condition or area other than eyelid xanthelasma;
  • your own misuse, alteration, or negligent use of the product; or
  • any indirect, consequential, special, or incidental loss, loss of profit, or loss of opportunity.

You agree to indemnify us, and our officers, employees, agents, and suppliers, against any claim, loss, liability, or cost (including reasonable legal fees) arising from your breach of these terms, your misuse of the product, or your use of it contrary to the supplied guidance or where a contraindication applied to you.

The exclusions and limitations in this section do not apply to, and nothing in these terms excludes or limits, our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; liability under the Consumer Protection Act 1987; the statutory rights you have as a consumer under the Consumer Rights Act 2015; or any other liability that cannot lawfully be excluded or limited under the law of England and Wales. Where liability cannot be excluded but can be limited, it is limited to the maximum extent the law allows. The remainder of this section applies as fully as the law permits regardless.

We use reasonable care in providing this website but make no warranty that it will be accurate, uninterrupted, timely, or error-free, and we are not responsible for third-party websites linked from it. We own all copyright, trademarks, trade names, logos, domain names, and other intellectual property in this website and its content. You may use or copy material only for your own personal, non-commercial use; any other use is prohibited. Nothing in these terms grants you any licence to use our marks. You may not link to this website without our prior written consent.

Accuracy of Billing and Account Information

We reserve the right to refuse any order, and to limit or cancel quantities purchased per person, household, or order, at our sole discretion, including orders that appear to be placed by dealers, resellers, or distributors. Privacy

We comply with applicable UK data protection law. By placing an order you confirm you have read and understood our Privacy Policy.

General

If we do not enforce a right under these terms, that does not waive it or prevent us enforcing it later. If any clause is found unenforceable, the rest of these terms continue in full effect, and the unenforceable clause is to be read down, or replaced, so as to give the maximum enforceable effect to our intention. Nothing in these terms confers any right on a third party under the Contracts (Rights of Third Parties) Act 1999, except that our officers, employees, agents, and suppliers may rely on the limitation, exclusion, and indemnity provisions. You may not assign or transfer your rights or obligations without our prior written consent; we may assign ours freely. These terms are the entire agreement between us on their subject matter and supersede any prior representations.

Governing Law

These terms, and any contract formed under them, are governed by the law of England and Wales and subject to the exclusive jurisdiction of the courts of England and Wales. Sales are concluded in English.
